He is in jail and they won't let him post bail because he is a flight risk. He was in Germany for a time but they caught him in Mexico and he was extradited to the states.

Why Herbie escaped intact I cannot say, I can only say that the alternative is a afterlife in some place where he can be chained and kept there so he can never damage another innocent soul ever again.
